West Virginia Ethics Commission Announces Requirement for Contract Disclosure, which Takes Effect July 7

CHARLESTON, W.Va. – As a result of a state law which passed during the 2017 Regular Session of the State Legislature, business entities entering into contracts with a value of $100,000 or more with state agencies will be required to submit to the agency “Disclosures of Interested Parties” relating to the contracts, beginning July 7, 2017.

W. Va. Code §§ 6D-1-1 through 6D-1-4, which set forth this requirement, may be downloaded from the West Virginia Ethics Commission’s website at www.ethics.wv.gov. The form disclosure is also available on the Ethics Commission’s website as well as the Purchasing Division’s website at WVPurchasing.gov.

The requirement also applies to a series of related contracts or orders in which the cumulative total exceeds $100,000. The statute provides that the business entity shall submit the Disclosure to the state agency no later than when the contract is submitted to the agency for signature and approval. Submission of a Disclosure as part of a bid is not required. Business entities also must submit supplemental Disclosure of Interested Parties reflecting any new or differing interested parties to the contract within 30 days following the completion or termination of the contract
